OVERVIEW

These Terms of Use ("Terms") are a legal agreement between you and Jeevandeep Edumedia Private Limited ("Jeevandeep", "we", "us" or "our") and govern your use of the following applications, which are published on the Apple App Store and Google Play.

and of the following web applications, 

• Periwinkle eLearning Web App

• Jeevandeep eLearning Web App

• Periwinkle Learning Platform

• Periwinkle Holistic Progress Card

• Periwinkle Test Maker

• Periwinkle LMS

collectively called the "Services".

Please read these Terms carefully before using the Services. By downloading, installing, registering for or using any of the Services you agree to be bound by these Terms and by our Privacy Policy, which forms part of these Terms. If you do not agree to these Terms, do not use the Services.

1. AGREEMENT TO TERMS

These Terms constitute a legally binding agreement between you and Jeevandeep concerning your access to and use of the Services. Where you use the Services on behalf of a school, college, coaching institute or other organisation (an "Institution"), you confirm that you are authorised to accept these Terms on its behalf, and "you" includes that Institution.

Supplemental terms shown at the point of purchase, in an order confirmation, in an invoice or in a written agreement between Jeevandeep and an Institution also apply and, where they conflict with these Terms, prevail for that purchase or agreement.

2. WHO MAY USE THE SERVICES

The Services are learning tools for students from Kindergarten to Class 10 and for the parents, guardians, teachers and Institutions who support them. Many of our users are children.

• If you are under 18 years of age, you may use the Services only with the permission and supervision of a parent or legal guardian, or of your Institution, who accepts these Terms on your behalf and is responsible for your use of the Services and for every purchase made through your account.

• Accounts on the Periwinkle Holistic Progress Card, Periwinkle Test Maker and Periwinkle LMS are created by Jeevandeep or by the Institution that subscribes to them, for its own staff and students. The Institution is responsible for the people it gives access to and for the data it enters about its students.

• You may not use the Services if you have previously been removed from them by Jeevandeep, or if doing so would be unlawful where you live.

3. YOUR ACCOUNT

To use most of the Services you need an account. You agree to give accurate and complete information when you register and to keep it current. You are responsible for keeping your password and sign-in method confidential and for everything that happens under your account. Tell us at once at solutions@jeevandeep.in if you believe your account has been used without your permission.

One account is for one person. Subscriptions, credits and purchases belong to the account they were bought on and cannot be moved to another account or shared with other people. You may ask us to delete your account at any time; see the Privacy Policy for how, and section 5 for what happens to unused purchases.

4. THE SERVICES AND THEIR CONTENT

The Services provide educational content and tools, including video lessons, textbooks and practice material, question banks and online tests, worksheets, teacher manuals, progress and grading records, and "AI Buddy", an assistant that answers questions about the content you are studying. We add, change and remove content and features from time to time, and a feature or title available today may not be available later.

AI Buddy generates answers automatically from the study material and may be incomplete or wrong. Its answers are a study aid, not a substitute for your textbook, your teacher or your own judgement, and we are not responsible for decisions taken on the basis of them.

5. PURCHASES, SUBSCRIPTIONS, CREDITS AND PRINTED BOOKS

A. Content subscriptions

Access to premium content in Periwinkle eLearning and Jeevandeep eLearning is sold as a subscription for a stated class, subject and period. The price, the content it unlocks and the period are shown before you pay. A subscription starts on the activation date and ends on the expiry date shown in the app; it does not renew automatically. Content is licensed to you for the subscription period only and is for your personal, non-commercial study.

B. Credits

Some features, such as AI Buddy answers and online tests, use credits that you buy in the app. Credits are deducted when you use the feature as described on screen, for example when a test begins or when an answer is delivered. Credits have no cash value, cannot be transferred, exchanged or withdrawn, and are not refunded for a test you start but do not finish.

C. Printed books

Where the app offers printed books, you place an order for physical goods that we ship to the address you give. You are responsible for the accuracy of that address. Goods and Services Tax is applied as required by Indian law and depends on the address. Goods are supplied at the consignee's risk once dispatched, and any discrepancy in an order or invoice must be brought to our notice within 3 days of delivery.

D. How you pay

Purchases made inside the iOS and Android apps are processed by Apple or Google under their own terms and billing systems, and purchases made on the web, as well as printed-book orders, are processed by our payment partner. We do not store your card or bank details. Prices are in Indian Rupees unless shown otherwise and may change at any time; a change does not affect a purchase you have already made.

E. Refunds and cancellations

All sales of digital content, subscriptions and credits are final and non-refundable, except where the law requires otherwise or where we say so in writing. If you have paid for a subscription and the content has not been unlocked, contact us with your payment details and we will either unlock the content for the full subscription period or refund the payment. For a purchase made through the Apple App Store or Google Play, any refund is handled by Apple or Google under their policies. Printed-book orders cannot be cancelled once dispatched.

F. Promo codes

A promo code unlocks the specific content it was issued for, is for a single account, may carry an expiry date and cannot be exchanged for money.

6. LICENCE AND ACCEPTABLE USE

Subject to these Terms, Jeevandeep grants you a limited, non-exclusive, non-transferable, revocable licence to use the Services and their content for your own personal, non-commercial education or, for an Institution, for teaching its own students. You agree that you will not:

• copy, download, record, screen-capture, distribute, sell, rent, publish or broadcast any video, book, test, worksheet, manual or other content, except where the Services provide a download for your own offline use;

• share your account, subscription, credits or promo codes with others, or use another person's account;

• modify, reverse engineer, decompile or attempt to extract the source code of the Services, or interfere with their security, servers or networks;

• use automated tools, scripts or bulk requests against the Services, or try to bypass access controls, content protection or usage limits, including those on AI Buddy and credits;

• upload or submit anything unlawful, abusive, infringing or harmful, or anything that is not yours to submit; or

• use the Services in any way that breaks the law, harms other users, or damages Jeevandeep or its reputation.

7. INTELLECTUAL PROPERTY

The Services and everything in them, including videos, books, questions, tests, worksheets, teacher manuals, illustrations, software, design, logos and trade dress, are owned by Jeevandeep or its licensors and are protected by Indian and international copyright, trademark and other laws. Nothing in these Terms transfers any ownership to you. "Jeevandeep", "Periwinkle" and the related names and logos are trademarks of Jeevandeep Edumedia Private Limited and may not be used without our written permission.

8. YOUR CONTENT AND INSTITUTION DATA

Content you enter into the Services, such as your profile details, test answers, questions you ask AI Buddy, feedback you send us, and the student records, marks and reports that an Institution enters, remains yours (or your Institution's). You grant Jeevandeep a limited licence to store, process and display that content only as needed to provide, secure and improve the Services. An Institution is responsible for having the right to enter the data it enters about its students and staff, and for keeping that data accurate.

9. PRIVACY

Our Privacy Policy explains what information we collect, how we use it and the choices you have. By using the Services you agree to it.

10. AVAILABILITY, UPDATES AND THIRD-PARTY SERVICES

We work to keep the Services available, but they may be interrupted for maintenance, updates, faults or reasons beyond our control, and we may change, suspend or discontinue any part of them. You are responsible for the devices, software and internet connection you use, and for keeping the apps updated; an outdated app may stop working or lose features.

The Services rely on third-party platforms and services, including Apple, Google, Firebase and our payment partner, and may link to websites and content we do not control. We are not responsible for third-party services or for their terms and practices.

11. SUSPENSION AND TERMINATION

We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, if we are required to by law, or if your use harms the Services or other users. On termination your licence ends and you must stop using the Services; unused subscriptions and credits are forfeited where the termination is for your breach. You may stop using the Services at any time and may ask us to delete your account.

12. DISCLAIMER OF WARRANTIES

The Services are provided "as is" and "as available". To the fullest extent permitted by law, Jeevandeep disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure or error-free, that the content is complete or accurate, or that using the Services will produce any particular academic result.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Jeevandeep, its directors, employees, partners and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or opportunity, arising out of or in connection with the Services or these Terms, however caused. Our total liability to you for all claims relating to the Services is limited to the amount you paid us for the Services in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. INDEMNITY

You agree to indemnify and hold harmless Jeevandeep and its directors, employees and partners from any claim, loss or expense, including reasonable legal fees, arising from your breach of these Terms, your content, or your misuse of the Services.

15. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of India. Subject to any rights you have under applicable consumer law, the courts at Mumbai, Maharashtra have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services. If any provision of these Terms is held invalid, the rest remain in effect, and our failure to enforce a provision is not a waiver of our right to enforce it later.

16. CHANGES TO THESE TERMS

We may change these Terms from time to time. The current version is always published at terms.jeevandeep.in with its "Last updated" date. For material changes we will give notice in the Services or by email where reasonably possible. Your continued use of the Services after a change takes effect means you accept the revised Terms.

17. APPLE-SPECIFIC TERMS

If you use Periwinkle eLearning or Jeevandeep eLearning on an Apple device: these Terms are between you and Jeevandeep only, not Apple; Apple has no obligation to provide maintenance or support for the apps; Apple is not responsible for any product warranty, product liability, consumer protection or intellectual property claim relating to the apps, except that, if an app fails to conform to a warranty, you may notify Apple and Apple will refund the purchase price of the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's standard Licensed Application End User Licence Agreement also applies to the apps.
